Each service engagement is governed by a separate proposal or service agreement specifying the scope, timelines, and payment terms.

3. Acceptance of Terms

By using our website or availing of our services, you:

• Confirm that you are at least 18 years old and legally capable of entering into a contract.

• Agree to be bound by these Terms and our Privacy Policy.

• Understand that we may modify these Terms anytime, and such changes will take effect immediately upon posting on our website.

4. Payments and Billing

• All payments must be made in advance unless specified otherwise in the proposal or invoice.

• Accepted payment methods include online transfer, UPI, credit/debit card, or other approved digital modes.

• Late or incomplete payments may result in service suspension or termination.

• Any applicable taxes, government levies, or transaction fees are the client’s responsibility.

• Once work has commenced, payments are non-refundable, except as stated in our Refund Policy.

5. Client Responsibilities

To ensure timely and effective delivery, the client agrees to:

• Provide accurate information, brand assets, and approvals as required.

• Maintain timely communication and respond to requests within reasonable timeframes.

• Ensure that all provided materials (logos, photos, content, etc.) are owned by the client or have proper usage rights.

• Adhere to all applicable laws and platform policies (Google, Meta, etc.) when running paid campaigns.

6. Intellectual Property Rights

• Upon full payment, the final creative assets and deliverables developed for the client become the client’s property.

• Marketing Geenie retains the right to display non-confidential work as part of its portfolio or case studies for promotional purposes.

• Any source files, software code, or proprietary systems developed by Marketing Geenie remain its intellectual property unless otherwise agreed in writing.

7. Confidentiality

Both parties agree to keep all business, marketing, and technical information confidential and not to disclose or use such information for any purpose other than fulfilling project obligations.

8. Performance Disclaimer

• Marketing and advertising results depend on numerous factors (market trends, ad budgets, competition, platform algorithms).

• Marketing Geenie does not guarantee specific results such as sales numbers, rankings, or conversions.

• While we make every effort to achieve the best outcomes, all projections are estimates and not guarantees.

9. Third-Party Services

• We may use third-party tools, APIs, or platforms (e.g., Google Ads, Meta, Mailchimp, etc.) to execute campaigns.

• Marketing Geenie is not liable for downtime, policy changes, or technical issues arising from third-party platforms.

10. Limitation of Liability

To the fullest extent permitted by law, Marketing Geenie shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services, including lost profits, data loss, or business interruption.

Total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for the service in question.

11. Termination

Either party may terminate a service agreement by providing a 15-day written notice.

• If the client terminates before project completion, payments for all work done up to the date of termination will remain due.

• Marketing Geenie reserves the right to terminate or suspend services immediately in case of non-payment, breach of contract, or misuse of services.

12. Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by and construed in accordance with the laws of India.
All disputes are subject to the exclusive jurisdiction of the courts in Jalandhar, Punjab.
